This NFC Card Policy explains how ThriveKiosks, a CrownThrive platform operated by CrownThrive LLC, manages the creation, activation, use, support, and limitations of NFC (Near Field Communication) cards connected to digital kiosks, vCards, and related services at thrivekiosks.com. This Policy works together with our Terms and Conditions, Privacy Policy, Cookie Policy, and Return and Refund Policy. By purchasing, activating, or using a ThriveKiosks NFC card, you agree to the terms outlined here.

1. Role of NFC Cards in the ThriveKiosks Ecosystem

ThriveKiosks NFC cards are physical extensions of your digital kiosk. When a compatible device taps or scans your NFC card, it reads a unique activation key and opens your assigned ThriveKiosks URL, such as your digital kiosk, business profile, or other approved destination within the CrownThrive ecosystem.

NFC cards are treated as custom, personalized tools that connect the physical world to the digital layers of CrownThrive, including the Thrive Flywheel, Cultural Imprint Engine, Hybrid Incubator, and future integrations governed under CHLOM and CHLOM LEX. The card itself is simply the gateway. Your kiosk content, offers, and compliance remain governed by the broader platform policies.

2. Custom Production and Unique Activation Keys

Every NFC card provided through ThriveKiosks is treated as a custom, made to order product. Cards may be printed, engraved, or otherwise branded with your identity, your business, or CrownThrive aligned designs. The card is then encoded or linked with a unique activation key generated within the ThriveKiosks platform.

These keys are assigned to your account and are used to connect your NFC card to a specific kiosk, page, or profile URL. For example, a card may write to a link in this structure:

https://thrivekiosks.com/nfc/[unique-activation-code]

The unique code itself is system generated and is considered sensitive platform data. You agree not to reverse engineer, tamper with, resell, or repurpose activation keys in a manner that violates our Terms and Conditions or any applicable law.

3. Activation Process

To protect both you and the platform, NFC cards must be activated before they function as intended. The standard activation flow is as follows:

  • You log in to your ThriveKiosks account using your credentials.
  • You navigate to the NFC activation or "Activate NFC Card" section in your dashboard.
  • You enter the unique activation code that was assigned to your NFC card and provided in your welcome or greeting letter.
  • You confirm the kiosk or URL destination you want the card to open.
  • The system links that activation code to your account and destination.

Once activation is submitted and confirmed, your NFC card becomes live. Any compatible device that taps or scans the card will be directed to the assigned URL, subject to device compatibility, network conditions, and any security checks in place.

4. Device Compatibility and Technical Limitations

NFC functionality depends on the device being used to tap or scan the card, the operating system version, and device settings. Not all devices support NFC, and some users may have disabled NFC capabilities on their phones or tablets.

ThriveKiosks does not control end user devices, network providers, or third party operating systems. As a result, we cannot guarantee that every device will successfully read every NFC card in every environment. You acknowledge that:

  • Some devices may not support NFC at all.
  • Some users may have NFC turned off in their settings.
  • Corporate or managed devices may restrict NFC behavior for security reasons.
  • Network outages or poor connectivity can prevent the URL from loading even when the NFC tap is successful.

These limitations do not create a right to refund. They are inherent to the technology and third party environments we do not control.

5. Free Shipping, Production Timelines, and Delivery

ThriveKiosks offers free outbound shipping on NFC card orders where stated. Free shipping covers the shipment from our production partners or fulfillment locations to the shipping address you provide at checkout. We reserve the right to choose the shipping carrier, route, and service level, which is typically ground or standard delivery.

NFC cards are produced through small batch and artisan oriented partners. Production may include design alignment, print proofing, physical creation, chip encoding, activation key assignment, and quality checks. This process can take additional time compared to generic mass produced items. Estimated production and delivery timelines are provided as guidance only and are not guaranteed.

Delays caused by carriers, customs, local regulations, weather, labor disruptions, or other external factors are outside of our direct control and do not create eligibility for a refund. This is consistent with our Return and Refund Policy.

6. Custom Nature and Non Refundable Status

NFC cards are classified as custom products under our Return and Refund Policy. Once a card enters production, it is considered permanently non refundable and non exchangeable except where required by applicable law. Custom work may include printing, engraving, embedding chips, serializing, and assigning unique activation codes tied to your account.

Because the value of the card is directly tied to one user and one activation pathway, it cannot be returned to inventory as a generic item. You agree that ordering an NFC card is equivalent to ordering a custom personalized product and that the normal rules for returns and refunds on standard retail items do not apply.

7. Risk of Loss, Damage, and Replacement

Risk of loss passes to you once the NFC card has been transferred to the shipping carrier for outbound delivery, to the fullest extent permitted by law. We will provide reasonable assistance with tracking shipments and resolving obvious shipping errors but cannot guarantee recovery of lost or stolen packages.

If an NFC card arrives damaged or unusable due to a manufacturing defect or encoding issue, you must contact us within a reasonable period after delivery with clear supporting information such as photos, video, or written description. We may, at our sole discretion and in line with applicable law, choose to:

  • Reissue or replace the NFC card.
  • Re encode or re assign the activation key.
  • Provide another reasonable remedy consistent with platform operations.

Lost, stolen, or misused NFC cards that are not defective are the responsibility of the card holder. We are not obligated to replace cards at no cost. Replacement cards, where offered, may require a new purchase.

8. Security, Misuse, and User Responsibilities

You are responsible for safeguarding your NFC card and any activation codes supplied to you. Anyone who physically holds your NFC card can tap it and access the assigned URL. If you assign your card to a public page, kiosk, or business profile, that content should be appropriate for public viewing and must follow all CrownThrive and ThriveKiosks content standards.

You must not use NFC cards to:

  • Deliver harmful, fraudulent, misleading, or illegal content.
  • Bypass platform security or licensing restrictions.
  • Phish users, harvest data unlawfully, or commit fraud.
  • Distribute malware or direct users to unsafe destinations.

ThriveKiosks may suspend, redirect, or deactivate an NFC link if we detect abuse, policy violations, or risk to the CrownThrive ecosystem. In serious or repeated cases, your account may be suspended or terminated as outlined in our Terms and Conditions.

9. Deactivation and Reassignment of NFC Links

You may be able to deactivate or reassign the destination of your NFC link from within your account, where the platform features allow this. Deactivation stops the link from resolving to your kiosk or page and may redirect to a general page, an error notice, or another location determined by ThriveKiosks.

Deactivation or reassignment of a link does not change the non refundable status of the original NFC card. Physical cards cannot be reset to a generic, non assigned state for resale or return.

10. Data, Privacy, and Analytics

When users tap an NFC card and visit your kiosk, their interactions may generate analytics, logs, or engagement data. These may include IP addresses, browser type, device type, timestamps, referring pages, or other technical metadata, as described in our Privacy Policy and Cookie Policy.

ThriveKiosks may use this information to improve services, enhance security, measure engagement, support CrownLytics and CrownPulse integrations in the future, and power ecosystem level analytics across CrownThrive. Data handling always follows our Privacy Policy and applicable data protection laws.

11. Relationship to CHLOM, CHLOM LEX, and Governance

NFC cards are identity tools that sit near the edge of the CrownThrive Identity Stack. They may, over time, interact with CHLOM based licensing, verification, or governance flows. For example, a card could eventually connect to licensed content, verified roles, or CHLOM LEX powered licensing agreements.

As these systems are deployed, additional rules or verification steps may apply to certain types of NFC linked content or licensed experiences. Any such requirements will be described in updated policies and governance documents, and your continued use of NFC tools will be subject to those updated rules.

12. Sustainability and Impact

ThriveKiosks participates in CrownThrive wide impact and sustainability initiatives coordinated through the future CrownThrive Impact Institute and related programs. While NFC cards are physical products, we aim to work with partners that prioritize responsible production practices whenever possible.

Your use of NFC cards may contribute indirectly to broader CrownThrive initiatives such as climate contributions, reforestation, ocean impact campaigns, or local ecosystem support, depending on current CrownThrive Impact efforts at the time of purchase. These programs do not change the legal terms of the NFC product itself but reflect our commitment to impact centered operations.

13. Limitation of Liability

To the maximum extent permitted by law, CrownThrive LLC and its affiliates are not liable for indirect, incidental, punitive, or consequential damages arising from the purchase, activation, use, loss, or failure of any NFC card. This includes, without limitation, damages related to lost business opportunities, lost revenue, disruptions in access, device incompatibility, or misuse by third parties.

Where liability cannot be excluded under applicable law, it will be limited to the amount paid by you to ThriveKiosks for the NFC card or service giving rise to the claim, to the extent allowed by that law.

14. Policy Changes and Continued Use

ThriveKiosks may update this NFC Card Policy from time to time to reflect changes in technology, law, platform capabilities, or CrownThrive ecosystem design. When this Policy is updated, the effective date at the top of the page will be revised.

Your continued use of NFC cards, activation tools, or NFC related features after an update means that you accept the revised Policy. If you do not agree with any future version of this Policy, you must stop using NFC cards with ThriveKiosks and contact us to discuss your options.
